The ‘036 patent dis­clos­es the appli­ca­tion of quan­ti­fied EEG to brain imbal­ances (e.g., phys­i­o­log­i­cal imbal­ances). The val­ue deliv­ered by using an EEG device entire­ly depends on the abil­i­ty to under­stand sig­nals gen­er­at­ed by the EEG device. Quan­ti­ta­tive analy­sis of these sig­nals has become a crit­i­cal aspect in EEG sig­nal pro­cess­ing. The claims of the 036′ patent explic­it­ly exclude cov­er­age of psy­chi­atric diag­noses, poten­tial­ly pre­sent­ing either an easy-design around or infringe­ment defense argu­ment. How­ev­er, the ‘036 patent oth­er­wise appears to have extreme­ly broad claim cov­er­age of quan­ti­ta­tive assess­ments for med­ica­tion treat­ments — one of the pri­ma­ry fac­tors mak­ing it a key non-inva­sive neu­rotech­nol­o­gy patent.

Abstract:

Neu­ro­phys­i­o­log­ic infor­ma­tion such as quan­ti­ta­tive elec­troen­cephalog­ra­phy (QEEG) is used in a method for clas­si­fy­ing, diag­nos­ing, and treat­ing phys­i­o­log­ic brain imbal­ances. Neu­ro­phys­i­o­log­ic infor­ma­tion is also used to guide sam­ple selec­tion in clin­i­cal tests for psy­chophar­ma­co­log­ic drug can­di­dates. Final­ly, neu­ro­phys­i­o­log­ic infor­ma­tion is used for remote­ly assess­ing and treat­ing patients with phys­i­o­log­ic brain imbalances.
